RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />INITIATING PROCEEDINGS FOR THE FORMATION OF A LANDSCAPE <br />MAINTENANCE ASSESSMENT DISTRICT TO BE KNOWN AS BONDE RANCH <br />LANDSCAPE MAINTENANCE DISTRICT 2026-2 <br /> <br />WHEREAS, the formation of the Bonde Ranch Landscape Maintenance District 2026-2 <br />(“District”) is being initiated pursuant to the Landscaping and Lighting Act of 1972 (the “Act”), <br />Division 15, Part 2, Chapter 2, Sections 22500 et. seq. of the California Streets and Highways <br />Code, for the installation, maintenance, and servicing of landscaping and other improvements; <br />and <br />WHEREAS, the Bonde Ranch Landscape Maintenance District 2026-2 is intended to <br />replace the Landscape Maintenance District 1993-2 (Bonde Ranch); and <br />WHEREAS, the Landscape Maintenance District 1993-2 (Bonde Ranch) will be replaced <br />only if there is not a majority protest against the proposed Bonde Ranch Landscape <br />Maintenance District 2026-2; and <br />WHEREAS, the City Council determines that said territory will be specifically benefited <br />by the maintenance and servicing of said improvements; and <br />WHEREAS, Section 22585 of the Act provides that the formation of Bonde Ranch <br />Landscape Maintenance District 2026-2 shall be initiated by resolution. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. SCI Consulting Group is hereby designated as Engineer of Work for <br />purposes of these proceedings and is hereby ordered to prepare an Engineer's Report in <br />accordance with Article 4 of Chapter 1 of the Act and Article XIIID of the California Constitution. <br />The Engineer’s Report shall include a description of the improvements, the boundaries of the <br />proposed assessment district, the estimated costs, the proposed method of assessment, and <br />the assessment diagram. Upon completion, the Engineer shall file the Engineer's Report with <br />the City Clerk for submission to the City Council. <br />SECTION 2. The proposed assessment district shall be designated as Bonde Ranch <br />Landscape Maintenance District 2026-2, City of Pleasanton, Alameda County, California, and <br />shall include that certain real property situated in the State of California, County of Alameda, <br />City of Pleasanton. <br />SECTION 3. The proposed improvements to be made in this assessment district are <br />generally described as follows: <br />The installation, maintenance, and servicing of designated landscaped areas, open space <br />slopes, fuel transition zones (fire breaks), entry features, open space drainage ditches, irrigation <br />systems, trees in the open space and designated landscape areas, and the furnishing of water <br />and power for irrigation systems, together with all appurtenant and incidental expenses within <br />Page 135 of 242
