As conditioned, staff believes that the proposed use will have adequate parking to meet
project demand. The bar would not play loud music, provide live entertainment, or
provide dancing areas for customers, thus avoiding possible adverse noise impacts on the
adjacent residents and businesses. Staff feels that any areas of possible concem have
been conditioned so that the proposed use will meet all applicable Municipal Code
requirements and would be operated in a non-nuisance manner. Furthermore, the
applicant can be required to mitigate any future nuisances or problems. Therefore, if all
the conditions of approval are complied with, staff feels the proposed bar will not
detrimentally impact the surrounding properties, and staff believes that this finding can
be made.

That the proposed conditional use will comply with each of the applicable provisions
of the zoning ordinance.

The site's Central Commercial zoning conditionally permits the establishment of bars. In
staffs opinion, the proposed use complies with all relevant sections of this ordinance.
Sufficient parking would be provided to serve the customers of the bar and to avoid
parking on Ray Street and Walnut Drive. Granting a conditional use permit to the
applicant for a bar is consistent with the City's ability to regulate zoning as listed in the
Municipal Code Chapter 18.124 "Conditional Uses." Therefore, staff believes that this
finding can be made.

VII. CONCLUSION

As proposed by the applicant and conditioned by staff, staffbelieves that the bar will be
compatible with the surrounding businesses and will not detrimentally affect the surrounding
uses or properties. Conditions of approval have been included which will ensure that the safety
and general welfare of the surrounding area, and the City in general, is maintained. Staff
understands that residents located behind the restaurant have expressed concerns with the
proposed hours of operation and with potential noise and parking issues; staff has seriously
considered these concerns and has worked with the applicant to tailor her proposal so that these
impacts would be minimized. The application raises the question of the appropriate interface
between businesses and residences in the Downtown commercial district, and staff and the PDA
believe that businesses on or very close to Main Street should be allowed to remain open late as
long as they operate in a manner which respects the nearby residents. Staff and the PDA believe
that an acceptable balance has been achieved with the applicant's proposal as conditioned, and
that the Crown's presence in the Downtown will be a benefit to the area.

Page - 10
