Commissioner Kameny nowd that the applicant's Danville pub was very enjoyable.

In response to an inquiry by Commissioner Sullivan, Mr. lserson confirmed that in
addition to the six-month review, that any problem would be brought before the
Commission.

THE PUBLIC HEARING WAS RE-OPENED.

In response to an inquiry by Mari Kennard, Commissioner Kameny confirmed that the
valet parking contract should be in place before she opened for business.

THE PUBLIC HEARING WAS CLOSED.

Chairperson Arkin noted that he would not support this application because it would
remain open past 10:00 p.m. next to a residential area.

Commissioner Roberts noted that the pub could stay open until 2:00 a.m., and that the
question addressed whether they could serve liquor after 10:00 p.m.

Commissioner Sullivan noted that although there was no opposition voiced during the
public hearing, he was aware of several e-mails which did stale opposition. He believed
the restaurant and the pub sounded good, but he was concerned about the late hours
during the week in a shared residential area. He did not believe that was a compatible use
in that respect. He suggested a compromise in which the pub would close at 10:00 p.m.
during the week, and later during the weekend.

Commissioner Roberts noted that if the late hours proved to be disruptive during the
week, that it would be brought before the Commission.

Commissioner Roberts moved to approve PCUP-92 as conditioned in the staff
report, with the addition that a legal binding agreement be signed with the owners
of 173 Spring Street for the valet parking prior to opening the business.
Commissioner Kameny seconded the motion.

ROLL CALLVOTE

AYES:
NOES:
ABSTAIN:
ABSENT:

Commissioners Kameny, Maas, and Roberts
Commissioners Arkin and Sullivan
None
None

Resolution No. PC-2003-39 was entered and adopted as motioned.

PLANNING COMMISSION MINUTES September 10, 2003 EXCERPTS
