Independent expert and/or consultant review, including legal <br />review, will generally be appropriate when considering an exception request, which <br />shall be at the applicant’s cost in the same manner as described in Section 8. <br /> <br />Section 16. VIOLATIONS <br /> <br />Any use or condition caused or permitted to exist in violation of any provision of this policy <br />shall be and hereby is declared a public nuisance and may be subject to : (a) injunctive <br />relief as set forth in Municipal Code Chapter 1.16 (Injunctive Relief); (b) administrative <br />citations as set forth in Municipal Code Chapter 1.24 (Administrative Citations); (c) <br />administrative remedies as set forth in Municipal Code Chapter 1.28 (Administrative <br />Remedies); (d) abatement pursuant to Municipal Code Chapter 9.28 (Property <br />Maintenance); and (e) any and all applicable processes and procedures pursuant to the <br />Municipal Code, including but not limited to Chapter 18.140 (Penalties), California Code <br />of Civil Procedure § 731, or any other remedy available to the City. <br />Docusign Envelope ID: 51CE5BDE-55F1-4B3D-8865-17E5814CF0C5
