ACFD shall remain fully responsible as employer for all taxes, premiums, wages, withholdings, and other direct and indirect compensation, benefits, and related obligations with respect to its own employees. It is further agreed that each Party shall be responsible for the claims of its own personnel for wage and disability payments, pension and fringe benefit payments, unemployment and worker’s compensation benefits, damage to equipment or clothing and medical expenses. ARTICLE IV TERM AND TERMINATION 1. Effective Date This Agreement shall commence on the date it is fully executed by the Parties, , 2026, and continue through December 31, 2027, or until terminated by written notice by one or both of the Parties as listed in paragraph 4 below. 2. Modification of Agreement This Agreement may be supplemented, amended, or modified only by the mutual agreement of the Parties. No supplement, amendment, or modification of this Agreement shall be binding unless it is in writing and signed by authorized representatives of both Parties. 3. Termination for Cause Any substantial reduction of fire fuels management services by ACFD or failure of a Party to mutually agree to modifications to this Agreement after conferring as provided above, shall be cause for termination of this Agreement by any Party. 4. Termination Either Party may terminate this Agreement without cause by giving the other Party thirty (30) days’ advance written notice of intention to terminate the Agreement. Either Party may terminate this Agreement with cause (as set forth in Article IV, paragraph 3, above) by giving the other Party advance written notice of intention to terminate the Agreement. In the event of termination, ACFD shall be paid for all services provided before the effective date of termination. IN WITNESS WHEREOF, this Agreement is dated the year and date first written above.
