It is beyond
the legal scope of the PEIR to define SB 1260 type conversion and statutory
compliance. The project proponent, acting as lead agency for the proposed later
treatment project, would be responsible for defining type conversion in the
context of the project and making the finding that type conversion would not
occur, as required by SB 1260. The project proponent would determine its criteria
for defining and avoiding type conversion and, in making its findings, may draw
upon information presented in this PEIR.
