SUBDIVISION IMPROVEMENT AGREEMENT TRACT 8724 Page 2 of 11 WHEREAS, as a condition precedent to accepting improvements by Subdivider, City requires the improvements to be constructed at Subdivider's sole expense (subject to applicable fee credit/reimbursement, if any) while providing certain security for the City on behalf of the public to ensure construction of same by Contractor. AGREEMENT NOW, THEREFORE, the City and Subdivider hereby agree that the aforementioned recitals are true and correct and incorporated herein by reference, and in consideration of the faithful performance of the promises, terms, conditions and covenants set forth herein by Subdivider, the parties hereto agree as follows: 1. Time of Essence. Time is of the essence in the performance of this Agreement. The work and improvements required by this Agreement to be completed by Subdivider shall be completed within two (2) years from the date this Agreement is executed, subject to any extension(s) granted pursuant to the terms hereunder. 2. Improvements. Subdivider will do or cause to be done and performed by Contractor the following described work of improvements pursuant to the Project Plans and Project bond estimates entitled: a. Tract 8724 – 0 Vineyard Avenue improvement plans dated _______________, ________ and subsequent revisions to plans prepared by CBG Engineers, approved by the City Engineer; and b. Engineer’s Bond Estimate In-Tract Improvements dated October 2, 2025 (2 sheets), see Exhibit A. 3. Inspection and Acceptance. In order to permit the City to inspect the work, Contractor shall provide to the City proper and safe access to the project site at all times. City shall inspect all of said Improvements within thirty (30) days upon completion of the Improvements through an inspector employed by City at the cost and expense of Subdivider, and Subdivider shall pay City the cost of such inspection as fixed by Ordinance. The City Engineer has tentatively fixed the permit, plan check, and inspection costs due upon execution of this Agreement as follows: $41.00 (permit) $174,459.60 (plan check) $232,766.80 (inspection) $407,226.40 (total)* *See Pleasanton Permit B25-2315 and E25-0480 4. Soils Report. Subdivider shall provide a preliminary soils report as required by Section 66490 of the Government Code.
