Force Majeure. Contractor’s time for completion of the Improvements shall be extended for the <br />period of any enforced delay caused due to circumstances beyond the control and without the fault of <br />Contractor, including to the extent applicable adverse weather conditions, flood, earthquakes, strikes, <br />lockouts, and required changes to the scope of work required by the City; provided however, that the <br />period of any enforced delay shall not include any period longer than five (5) business days prior to the <br />City’s receipt of a written notice from Subdivider or its Contractor detailing the grounds for <br />Subdivider’s claim to a right to extend its time for performance hereunder. The City Engineer shall <br />evaluate all claims for Force Majeure and the City Engineer’s decision shall be final. <br /> <br />17. Notices. All notices herein required shall be in writing and shall be delivered in person or sent <br />by certified mail, postage prepaid, or email.
