Developer shall be solely and exclusively
responsible for all design and installation costs of said traffic signal
improvements, which shall meet all City specifications and standards.

4. Payment of a monetary contribution in the amount of $500,000 to be used by
City for future improvements to Dublin Canyon Road, including the potential
widening of the Devany Creek bridge in order to improve traffic circulation and
enhance public safety; and

5. Provision of 28 units of housing to meet the growing needs of the Pleasanton
business community that are consistent with the City’s certified Housing Element,
contribute to the City’s housing needs assessment and Regional Housing Needs
Allocation (RHNA) within the City.

6. CEQA Compliance. An Environmental Impact Report (EIR) was prepared for the Project and
certified by the City in accordance with the California Environmental Quality Act (CEQA),
along with adoption of a Mitigation Monitoring and Reporting Program (MMRP) and Findings
of Fact (FOF). The EIR evaluated the environmental impacts associated with development
of the project site, including annexation, General Plan amendments, rezoning, and
development of residential uses and associated improvements. The environmental review
analyzed site-specific and cumulative impacts related to aesthetics, air quality, biological
resources, cultural resources, geology and soils, hydrology, noise, transportation, and other
applicable resource areas.
The EIR concluded that, with implementation of mitigation measures identified in the MMRP,
the majority of environmental impacts would be reduced to a less-than-significant level.
However, an environmental impact related to Vehicle Miles Traveled (VMT) was identified as
significant and unavoidable, even with implementation of all feasible mitigation measures, as
the residential VMT per capita could not be reduced beneath the applicable threshold. In
connection with certification of the EIR, the City adopted a Statement of Overriding
Considerations, finding that the benefits of the Project outweigh this significant and
unavoidable environmental impact.
The Project, as proposed, is consistent with the development assumptions and land use
framework evaluated in the EIR. The environmental analysis determined that there are no
new significant impacts or substantially more severe impacts than those identified in the
certified EIR. Additionally, there are no new project-specific or site-specific impacts that were
not previously analyzed. All applicable mitigation measures identified in the EIR have been
incorporated into the Project as conditions of approval and will be implemented in
accordance with the adopted MMRP.
Accordingly, the environmental effects of the Project have been adequately addressed in the
certified EIR, and no additional environmental review is required pursuant to CEQA.
7. Project Approvals. City has undertaken several actions to plan for future housing on the
Project Site, including, without limitation, the following approvals (“Project Approvals”):
