Page 6
Introduction
Executive Summary
The Windsor Landscape Maintenance District, 1993-1, was created in 1993 as a
means to fund the maintenance of the landscape and common areas for the
Windsor subdivision, a 90-parcel development. The district was formed prior to
the passage of Proposition 218, the "Right to Vote on Taxes Act" which requires
property owner approval to impose or increase assessments.
At the time of formation, no inflation escalator was built into the assessment and
the district assessment has remained at $265.11 since formation. The lack of an
inflation escalator has led to a decline in the level of maintenance, a lack of
sufficient funding for capital improvement projects, and an irrigation system that
is badly in need of a major renovation. The level of maintenance required as part
of the development approval is no longer manageable, which exposes the district
and the property owners to increased liability.
In 2022, staff held outreach meetings with the district property owners and HOA
Board to discuss a Proposition 218-compliant voting procedure.Although property
owners were not supportive of an increase in assessments, the HOA agreed to take
over routine maintenance and pay for the costs of water. The HOA acceptance of
partial maintenance responsibilities is only a first step though,as assessment levels
are $265.11 per parcel annually while maintenance costs are estimated to be
closer to $400 per parcel annually to properly maintain the district even with the
HOA paying for water and routine maintenance costs, and likely about double that
amount if the HOA no longer supplements services. Either the HOA will need to
take over the district maintenance or a Proposition 218-compliant vote will be
required to address the maintenance needs of the district. The budget for this
fiscal year will aim to continue to pay down the deficit, but significant tree pruning
work is required and the district will need to remove the nonfunctional turf due to
AB 1572, which will also require a significant investment over time.
City of Pleasanton
Landscape Maintenance District No. 1993-1, Windsor SCIConsultingGroup
Engineer's Report
