CONTRACT BETWEEN <br /> ZONE 7 OF ALAMEDA COUNTY FLOOD CONTROL AND WATER <br /> CONSERVATION DISTRICT AND CITY OF PLEASANTON FOR A <br /> MUNICIPAL & INDUSTRIAL WATER SUPPLY <br /> THIS CONTRACT is made and entered into this day of , <br /> 2026, by and between ZONE 7 OF ALAMEDA COUNTY FLOOD CONTROL AND WATER <br /> CONSERVATION DISTRICT, commonly known as the Zone 7 Water Agency, hereinafter <br /> referred to as "Zone 7" and CITY OF PLEASANTON, hereinafter referred to as <br /> "Contractor." <br /> RECITALS <br /> WHEREAS, Zone 7 is a wholesale water supplier providing Municipal and <br /> Industrial water supply to various contractors in Alameda County and Dougherty Valley; <br /> and <br /> WHEREAS, Zone 7 manages the Livermore Valley Groundwater Basin under the <br /> Sustainable Groundwater Management Act of 2014 (SGMA) through the Alternative <br /> Groundwater Sustainability Plan for the Livermore Valley Groundwater Basin; and <br /> WHEREAS, Contractor and Zone 7 are parties to the Zone 7 of Alameda County <br /> Flood Control and Water Conservation District's Terms and Conditions for a Municipal <br /> and Industrial Water Supply to the City of Pleasanton (M&I Contract); and <br /> WHEREAS, that M&I Contract provides for Zone 7's sale of treated water to <br /> Contractor and for the administration of Groundwater Pumping Quotas for Contractor's <br /> extractions from the Main Basin of the Livermore Valley Groundwater Basin; and <br /> WHEREAS, the M&I Contract between Zone 7 and Contractor expires December <br /> 31, 2026; and <br /> WHEREAS, Zone 7 and Contractor wish to renew the terms of the prior M&I <br /> Contract, and to provide for future water supply to Contractor's Service Area. <br /> A. INTRODUCTORY PROVISIONS <br /> NOW, THEREFORE the Parties agree as follows: <br /> 1.
