a. Design and installation of an EBRPD staging area including parking, bathrooms and water and a trail extension to the north end of the Pleasanton Ridge trail, subject to review and approval by the City and the EBRPD, for which Developer shall be solely and exclusively responsible for all design and installation. Prior to the City issuing the first building permit for the Subdivision, Developer shall enter into an agreement with EBRPD to provide a permanent proportional funding source for the ongoing maintenance of said staging area improvements. b. EBRPD Staging Area: Completion of the staging area, improvements, and trail access during the initial development before final inspection by the City of the 11th home in the Subdivision, with periodic check-ins for Park District review during construction. c. Prior to the City issuing the first building permit for the residential subdivision, Developer shall establishment of an appropriate long-term funding mechanism such as a Community Facilities District (CFD) to cover expenditures for maintenance of the proposed staging area, trail, and dedicated open space for fire, public safety, and operational needs. d. Dedication of 69 acres of public open space to EBRPD, which shall be subject to a conservation agreement with EBRPD. The conservation agreement shall preserve the open space indefinitely, shall set forth the obligations of EBRPD to monitor and maintain the public open space and shall be subject to review and written approval by the City. Building permits for the residential subdivision shall not be issued until the conservation agreement is reviewed and approved by the City. e. Design and installation of a traffic signal and related improvements located at Dublin Canyon Road and Canyon Meadows Drive that will improve access for the Oak Hills Congregation of the Jehovah’s Witness Church located at 10971 Dublin Canyon Road and the Canyon Meadows neighborhood located on Dublin Canyon Road, subject to the review and approval by the City. Developer shall be solely and exclusively responsible for all design and installation costs of said traffic signal and related improvements. The design of the traffic signal and related Dublin Canyon Road improvements shall be included with the construction plans submitted to the City, and shall be subject to the review and approval of the City’s Traffic Division prior to issuance of permits. The traffic signal shall be installed before final inspection by the City of the 11th home in the Subdivision. f. Payment of a monetary contribution in the amount of $500,000 to be used by City for future improvements to Dublin Canyon Road, including but not limited to, the potential widening of the Devany Creek bridge in order to improve traffic circulation and enhance public safety. Payment shall be made prior to issuance of any City permits. g. Provision of 28 units of housing to meet the growing needs of the Pleasanton community that will promote and serve the housing needs of burgeoning Pleasanton’s growing technology and related businesses within the City.
