4. On June 14, 2022, prior to filing a formal development application, Developer filed a
Preliminary Application pursuant to Senate Bill (SB) 330 with Alameda County. On November
18, 2022, Developer submitted a Development Plan and Vesting Tentative Subdivision Map
Application (TR-8423) (collectively referred to herein as the “County Development
Application”) for a total of one hundred ninety four (194) market rate single-family detached
homes and a minimum of forty nine (49) deed restricted accessory dwelling units (collectively,
“ADUs”), along with related on- and off-site improvements to serve the proposed residential
uses (collectively, the “County Proposal”).
5. On February 17, 2023, the County deemed the County Development Application
complete and thereafter made a consistency determination. The discretionary entitlement
process for the County Proposal was subject to compliance with CEQA. To satisfy requirements
under CEQA, the County, as lead agency, caused the preparation of an environmental impact
report for the County Proposal (SCN: 2023050339), which consists of the Draft Environmental
Impact Report, the Final Environmental Impact Report, and all appendices attached thereto
(collectively, the “Project EIR”). As detailed more fully therein, the Project EIR evaluated the
impacts of the construction and operation of the County Proposal as well as included an
alternatives analysis that considered annexation of the Project Site into City for purposes of
developing the proposed residential uses. City participated in the process for the Project EIR,
including providing the County with comments thereon. On January 5, 2026, the County
Planning Commission certified the Project EIR and approved the various discretionary
entitlements associated with the County Development Application to allow the County Proposal
to proceed. Thereafter, an appeal was filed by Zone 7 challenging the certification of the Project
EIR and the Planning Commission’s approval of the Project. On February 10, 2026, at a duly
noticed public hearing, the Alameda County Board of Supervisors heard, considered and took
action, denying the appeal, certifying the Project EIR, adopting the necessary CEQA findings,
and approving the Project.
6. On February 18, 2025, the Pleasanton City Council (“City Council”) considered the
potential merits of annexation of the Project Site to allow for the development of the Project into
the City, and provided direction to Developer to proceed with applications for annexation into the
City. On February 25, 2025, formal applications for annexation and development were formally
submitted to City, with the County Development Application continuing to be concurrently
processed by Alameda County. On October 20, 2025, the City Council considered the key terms
of this Agreement and provided further direction to City staff and Developer in this regard, and
also directed the Parties to proceed with preparing and finalizing this Agreement for
consideration by the City Council.
7. Despite obtaining entitlement approvals from the County, Developer has requested
that the Project Site be annexed into the City, and related thereto Developer has proceeded to
modify portions of the County Proposal (as reflected in the Project) to more closely align with
applicable City development standards, adjusted grading, selected lot configurations, home
designs and unit count to provide a better transition to the adjacent Village at Ironwood
subdivision. Developer has also requested access to City services for purposes of the Project
development, including but not limited to, water, sewer, police, fire and other government
services. Developer applied for the following Project Approvals (defined below) from City: (a)
General Plan Amendment (P25-0116) to designate the Project Site Medium Density Residential
(MDR); (b) Pre-zoning (P25-0118) for the Project Site to Planned Unit Development (PUD) –
MDR and related Planned Unit Development/Planned Unit Development Plan (PUD-154); (c)
Request for City to initiate Annexation Proceedings (P25-0115); (d) Vesting Tentative Map
(Tract No. 8423); and (e) this Agreement.
