Should the City Council wish to approve the project, staff would
evaluate it for CEQA compliance and return to the City Council at a future public hearing for
formal consideration and action.

SUMMARY/CONCLUSION
The project plans are incomplete and inconsistent with numerous policies, standards and
guidelines of the General Plan, DSP, Downtown Design Guidelines, applicable ODS, and
PMC regulations. The PUD District is intended to promote well-planned projects that achieve
high-quality design, superior site planning, and compatibility with surrounding uses while
advancing adopted General Plan and specific plan goals.

Significant efforts were made throughout the process to work with the applicant and develop a
project scope and design that could be supported by staff. Several iterations of the project
were presented, including versions with and without a commercial component, in various
configurations, and with staff generally encouraging the applicant to come as close as
possible to meeting key standards for frontage design, dimensions, and functionality of the
commercial space. While the PUD process allows for deviations or flexibility in considering
strict adherence to established standards, the applicant ultimately requested that the version
of the project under consideration by the City Council be brought forward for review. Despite
efforts to work constructively with the applicant to make changes to the project to better align it
with key policies and standards, the proposed project continues to fall short in multiple areas
of policy conformance.

Staff finds that the proposed project does not satisfy the objectives of the PUD District, and
given the number and extent of the requested deviations from applicable standards and
regulations, the required findings for approval cannot be made. Accordingly, staff recommends
that the City Council adopt the attached resolution (Attachment 1) to deny the applications for
Rezoning, a Certificate of Appropriateness, and a PUD Development Plan for Case Nos. P26-
0360 and PUD-152.

EQUITY AND SUSTAINABILITY
Not applicable to this project, since this is a routine item of City business.

OUTREACH
Notice of this application was sent to property owners and tenants/occupants within a 1,000-
foot radius of the subject site (Attachment 2, Exhibit F), and the applicant has posted project
identification signage on-site. At the time this report was published, no public comments had
been received. Public comments received after publication will be forwarded to the City
Council.

STRATEGIC PLAN ALIGNMENT
Not applicable to this project, since this is a routine item of City business.

FISCAL IMPACT
Not applicable to this project, since this is a routine item of City business.
