Resolution No.
Page 3

The City Council finds that the proposed future use and design of the property
are inconsistent with PMC Chapter 18.74 and the adopted Downtown design
guidelines. The Project does not maintain the commercial or mixed-use
character intended for the site, lacks active ground-floor engagement with the
public realm, and introduces building form, scale, and orientation that are not
consistent with the pedestrian-oriented design and architectural standards
required within the Downtown Revitalization District. Accordingly, the criteria
for issuance of a Certificate of Appropriateness are not met. As such, the City
Council finds that this finding cannot be made.

The City Council further finds that the applicant has not established that there
is unnecessary hardship in the strict application of PMC Chapter 18.74.

SECTION 5. Findings for PUD Development Plan Denial
With respect to the denial of PUD-152, the City Council makes the following findings as
required by Section 18.68.110.B (1) - (7) of the PMC:

1. Whether the proposed development plan is in the best interest of the
public health, safety, and general welfare.

The City Council finds that the proposed project does not adequately support
the public health, safety, and general welfare due to several unresolved
design and site planning concerns. The project includes limited pedestrian
connectivity from the public right-of-way to unit entrances and lacks clearly
identifiable street-facing entries, which may reduce opportunities for natural
surveillance (“eyes on the street”) and create potential circulation conflicts. In
addition, outstanding inconsistencies and incomplete details within the project
plans—including items related to utilities, stormwater management, and unit
access—limit the City’s ability to fully evaluate compliance with applicable
development and safety standards. The project also provides limited private
usable open space, includes a unit mix and building configuration that results
in a concentration of mass within a large single building, lacking a pedestrian-
oriented frontage. Furthermore, the proposed setbacks, building height, and
transitions adjacent to lower-scale residential development raise concerns
about neighborhood compatibility and appropriateness of the scale of the
building as designed and sited. Taken together, these issues indicate that the
project, as currently proposed, does not demonstrate a fully compatible and
well-integrated residential development. As such, the City Council finds that
this finding cannot be made.

2. Whether the proposed development plan is consistent with the
Pleasanton General Plan and any applicable specific plan.

The proposed development plan is not consistent with the applicable goals
and policies of the Pleasanton General Plan and the Downtown Specific Plan
(DSP). The subject site is designated Mixed-Use under the General Plan and
Page 248 of 373
