RECEIVED <br /> HERITAGE TREE PROTECTION AGREEMENT <br /> C C.I 14 2015 WITHIN TRACT 5945 <br /> (GOLDEN EAGLE FARMS) <br /> Cffy OF PLEASANTON BLDG <br /> THIS AGREEMENT is made this day of Tci 2015, <br /> between Nagib Haddad, ("Homeowner"), the GOLDEN EAGLE HOMEOWNERS <br /> ASSOCIATION ("Association") and the CITY OF PLEASANTON ("CITY") <br /> RECITALS <br /> A. Homeowner is a property owner within Tract 5945, a single family subdivision <br /> within the City of Pleasanton, commonly known as Golden Eagle Farms. <br /> B. Homeowner has applied to the City for design review approval for a single family <br /> residence at 8019 Golden Eagle Way. <br /> C. There are heritage trees on this property. <br /> D. One of the conditions of the City's approving design review for this residence is that <br /> the Homeowner obtain a written statement from the Association to ensure that the <br /> all heritage trees on the property will be protected, both during development of the <br /> lot and thereafter. <br /> NOW, THEREFORE, in consideration of the mutual promises expressed herein, the <br /> parties agree as follows: <br /> 1. City grants design review approval for the property at 8019 Golden Eagle Way, <br /> Pleasanton, California, Lot 2 within Tract 5945. <br /> 2. Homeowner shall protect and maintain all heritage trees on the property, both <br /> during development of the property and thereafter. <br /> 3. If the City, in its sole discretion, determines that a heritage tree on the property is <br /> destroyed or substantially damaged, Homeowner and/or Association shall pay to <br /> City $5,000 per tree within thirty (30) days of the City's notice to pay said amount. <br />
