Resolution No. 2026-071
inconsistencies with the required findings listed in PMC Section 18.74.190 and Section
18.68.110.B.1 through 7, and as outlined in Sections 3 and 4 below; and
WHEREAS, pursuant to Section 65905 of the Government Code, the City Council held a
duly noticed public hearing to consider the Project on August 11, 2026, at which time all interested
parties had the opportunity to be heard. The City Council considered the agenda report dated
August 11, 2026, incorporated herein by reference, and all written and oral testimony.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES
RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING:
SECTION 1. Prior to making a recommendation on the Project, and at a properly noticed
public hearing, the City Council reviewed written and oral agenda reports, conducted a public
hearing on the Project and took testimony, and received into the record all pertinent documents
related to the Project (collectively, the "Record Evidence"). The City Council's determination is
based on its own independent review of the Record Evidence, which is incorporated into this
Resolution by reference.
SECTION 2. Findings for California Environmental Quality Act (CEQA). The project is
exempt from the California Environmental Quality Act(CEQA) pursuant to Public Resources Code
Section 21080(b)(5) and CEQA Guidelines Section 15270, which statutorily exempt projects that
a public agency intends to deny.
SECTION 3. The Project is not consistent with the adopted General Plan as it does not
aligns with the applicable land use designations and supports the General Plan's Programs,
Policies, and Goals related to sustainability, community development, and housing element. As
such, the Project does not comply with the requirements of Government Code Section 65860
regarding zoning consistency with the General Plan.
SECTION 4. The proposed demolition would have an adverse effect on adjoining property,
or on the built context; or
3. The proposed future use and design of the property would be inconsistent with
PMC Chapter 18.74 or the adopted guidelines.
The City Council finds that the proposed future use and design of the property are
inconsistent with PMC Chapter 18.74 and the adopted Downtown design guidelines.
The Project does not maintain the commercial or mixed-use character intended for the
site, lacks active ground-floor engagement with the public realm, and introduces
building form, scale, and orientation that are not consistent with the pedestrian-
oriented design and architectural standards required within the Downtown
Revitalization District.
