Box 520 <br />Pleasanton, CA 94566 <br /> <br />SUBJECT: Workers' Compensation & Automobile Liability Scope Verification – Maintenance and <br />Trade Services Agreement for Pest Control Services <br /> <br />Dear City of Pleasanton Risk Management: <br /> <br />Pursuant to Section 5(c) of the Maintenance and Trade Services Agreement for Pest Control <br />Services, this letter serves as formal written verification regarding the operating structure and <br />insurance coverage of Clear 'Em Out Pest Control: <br /> <br />1. Sole Proprietorship Status & Zero Employees: <br />Clear 'Em Out Pest Control is an unincorporated sole proprietorship owned and operated solely <br />by Vincent Tyrone Clear. The business employs zero (0) employees, apprentices, or <br />subcontractors. All route inspections, pest treatments, pesticide applications, and administrative <br />duties under this Agreement will be performed 100% directly and personally by the <br />owner-operator. <br /> <br />2. Workers' Compensation Exemption: <br />Because Clear 'Em Out Pest Control has no employees, the business is exempt from statutory <br />Workers' Compensation and Employer's Liability Insurance under California Labor Code Section <br />3700. Per Section 5(c) of the Agreement, we respectfully request that the City waive the <br />Workers' Compensation insurance requirement. If any employee is hired during the term of this <br />Agreement, statutory Workers' Compensation coverage will be bound immediately, and a <br />compliant Certificate of Insurance will be submitted to the City prior to any work being <br />performed. <br /> <br />3. Automobile Liability Scope: <br />All services rendered under this Agreement are performed using the company's dedicated <br />commercial vehicle (2026 Chevrolet Silverado, VIN: 1GC10ZED7TU403667), insured under <br />Progressive Commercial Policy #871795411 at the full $2,000,000 Combined Single Limit, with <br />the City named as Additional Insured with a Waiver of Subrogation.
