To avoid
potential impacts, MM BIO-1a and MM BIO-1b require protocol-level surveys for burrowing owls per
CDFW guidelines and establishment of no-activity zones during nesting seasons. For nesting birds,
pre-construction surveys are required if vegetation removal occurs between February 1 and August
31. If active nests are found, appropriate buffers must be established and monitored. These
measures are designed to prevent nest abandonment and help to ensure reproductive success.
With no off-site utility improvements, Alternative 2 would avoid development in areas east of El
Charro Road where sensitive biological resources are present, reducing the potential for impacts on
wildlife and habitats. For this reason, biological impacts for Alternative 2 would be slightly lower than
the County Project, though mitigation for the residential component would still be required. (Draft EIR,
p. 6-13). Therefore, with respect to both the County Project and Alternative 2, the Prior FEIR
concluded that impacts would be less than significant with mitigation incorporated. (Draft EIR, pp. 3.3-
26, 6-13).
