PARK CONDITION
AGREEMENT
THIS AGREEMENT is made this 7th day of May, 1996, between the City of
Pleasanton a Municipal Corporation, ("City") and the Bernal Avenue Associates
("Owner").
RECITALS
As major business parks and other commercial/office/industrial projects were
being approved in Pleasanton in the mid-1980's, the City became aware of the need for
park and recreation facilities to meet the requirements of employees of businesses
locating in these projects; however, information concerning the effects of such
employees, particularly non-resident employees, on local park and recreational facilities
was lacking at that time.
Faced with similar situations concerning the need for, and methods to fund,
facilities for water, fire, and street improvements (primarily in the North Pleasanton area),
the City required studies be done for new commercial/office/industrial projects; these
studies' recommendations were implemented through assessment districts.
Subsequently, the City, by condition of approval, required several major business
parks to fund a study of the reasonable park and recreation facilities' needs of their
employees and the manner of participation in the capital costs for the facilities
determined necessary.
As commercial/office/industrial projects were approved, the City imposed a
condition (hereafter "the Park Condition") on the projects obligating the projects to pay
for the park and recreation facilities' needs of their employees (the "Park Obligation").
Thereafter, several surveys and studies were conducted to assist in quantifying the
obligation of the Park Condition.
The surveys and studies concluded the maximum Park Obligation would be
$159-$172/employee.
City representatives have met with the various property owners whose properties
have the Park Obligation in an effort to seek consensus on the amount of the Park
Obligation as well as on the funding mechanism.
(PARKBAASAM) 1
