Attachment 1 <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING A PURCHASE AGREEMENT WITH VAC-CON, INC. FOR ONE VAC-CON <br />VXPD4214LHE/1100 HYDRO-EXCAVATOR TRUCK IN AN AMOUNT NOT TO <br />EXCEED $856,491, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT <br /> <br /> <br />WHEREAS, the City of Pleasanton desires to replace Water Division Unit No. 300, a 2016 <br />Vac-Con Hydro-Excavator Truck; and <br /> <br />WHEREAS, Vac-Con, Inc. has the necessary qualifications, experience, and ability to <br />provide one Vac-Con VXPD4212LHE/1100 Hydro-Excavator Truck; and <br /> <br />WHEREAS, the City has negotiated a purchase agreement with Vac-Con, Inc. for one <br />Vac-Con VXPD4212LHE/1100 Hydro-Excavator Truck through the Sourcewell Cooperative <br />Purchasing Program; and <br /> <br />WHEREAS, the total compensation under the purchase agreement shall not exceed <br />$856,491, unless otherwise authorized in accordance with City procedures; and <br /> <br />WHEREAS, funding for the purchase agreement is available in the Water Enterprise Fund <br />(Account No. 42442101-440107); and <br /> <br />WHEREAS, the City Council has considered the staff report and all information presented <br />at its regular meeting on September 15, 2026. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> <br />SECTION 1. The City Council approves the purchase agreement with Vac-Con, Inc. for <br />one Vac-Con VXPD4212LHE/1100 Hydro-Excavator Truck, in an amount not to exceed <br />$856,491. <br /> <br />SECTION 2. The City Manager is authorized to execute the purchase agreement, subject <br />to minor modifications approved by the City Attorney. <br /> <br />SECTION 3. The City Manager, or designee, is authorized to take all actions necessary <br />to implement the purchase agreement, including execution of related documents, notices, <br />amendments, extensions, and administrative actions, provided such actions are consistent with <br />the approved budget and City policies. <br /> <br />SECTION 4. This resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on September 15, 2026. <br /> <br />I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 15 day of September, <br />2026, by the following vote: <br />Page 126 of 318
