<br /> <br /> <br />To: Ellen Clark, Dir. of Community and Economic Development Dept., City of Pleasanton <br />From: James Wawrzyniak and Dave Fama, Jones Hall LLP <br />Date: April 28, 2026 <br />Re: Scope of Services and Fee Proposal for Citywide CFD <br /> <br /> <br />Formation of CFD for City Services/Maintenance <br /> <br /> <br />Scope of Services. <br /> <br />With respect to formation of the proposed community facilities district (CFD), Jones Hall <br />would perform all of the services that are normally performed by special legal counsel in <br />connection with the formation of a CFD under the Mello-Roos Community Facilities Act of 1982 <br />(Act), including: <br /> <br />• Advising the City on the steps required to form the CFD under the Act, including <br />with respect to the establishment of the initial CFD boundary and a future <br />annexation area, setting different special tax rates for different zones of the CFD, <br />and setting the authorized list of services/maintenance. <br /> <br />• Preparing all resolutions, ordinances, notices, election ballots, and certificates that <br />are required to (1) form the CFD; (2) conduct the CFD special tax election in <br />accordance with the Act; and (3) authorize the City to levy special taxes within the <br />CFD for authorized City services/maintenance pursuant to City ordinance. <br /> <br />• Establishing and/or updating CFD goals and policies for the City, as required by <br />the Act. <br /> <br />• Reviewing and commenting on drafts of the CFD Boundary Map and Rate and <br />Method of Apportionment (RMA) prepared by the City’s special tax consultant. <br /> <br />• Working with the City Clerk and the special tax consultant to record the CFD <br />Boundary Map and the Notice of Special Tax Lien with the County Recorder’s <br />Office. <br /> <br />• Attending all City staff and City Council meetings, public hearings and workshops <br />at which matters relating to the formation of the CFD are considered and Jones <br />Hall is requested to attend. <br /> <br />Fee Proposal. <br /> <br />For the work described above, Jones Hall would propose a flat fee of $15,000, payable <br />upon completion of the final step in the CFD formation process described above. <br />Docusign Envelope ID: EAF8C407-5798-8C1C-81FE-967A519B3B89Docusign Envelope ID: CD4E9FCF-88EB-8E8A-82C6-053B202B7474
