.r, Ir <br /> AGREEMENT <br /> THIS AGREEMENT made this 20th day of April , 1981, by <br /> and between ROBERT MOLINARO, hereinafter called "Applicant" and the CITY <br /> OF PLEASANTON, a political subdivision of the State of California, hereinafter <br /> called "City". <br /> WITNESSETH <br /> WHEREAS, Applicant is the owner of real property situate in the City of <br /> Pleasanton, County of Alameda, California, which property is described as <br /> follows: See legal description attached hereto and marked Exhibit "A" and made <br /> a part hereof and incorporated herein by reference. <br /> WHEREAS, Applicant seeks to subdivide said real property into four (4) <br /> parcels; and <br /> WHEREAS, City has approved the subdivision of said property into four (4) <br /> parcels subject to the condition that Applicant provide a non-refundable cash <br /> payment prior to recordation of the Parcel Map as an "in lieu" payment for <br /> frontage improvement along the Stanley Boulevard frontage equivalent to curb, <br /> gutter, sidewalk and twenty (20) feet of structure pavement measured from <br /> future face of curb; and <br /> WHEREAS, Ron Archer Civil Engineer, Inc. has prepared a detail of off- <br /> site improvements in accordance with the foregoing condition, a copy of which is <br /> attached hereto as Exhibit "B" and made a part hereof and incorporated herein by <br /> reference; <br /> NOW THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED <br /> that: <br /> 1. Applicant will provide City with a cash payment sufficient to include <br /> the costs of items set forth in Exhibit "B" (a) within thirty (30) days after notice <br /> from the City Engineer that frontage improvements will take place; or (b) at <br /> such time as Applicant develops said property, whichever shall first occur. <br /> 2. In consideration thereof, City waives the requirement of a cash <br /> payment prior to recordation of the parcel map. <br /> -1- <br />
