by Developer shall be made, to be used by City for the purpose of designing and constructing El
Charro Road as a public road connection of up to four lanes from Stoneridge Drive to Busch
Road and/or Stanley Boulevard ("El Charro Extension") in order to improve circulation within
the broader East Pleasanton area and within the City.
vi. Construction of a total of forty-eight (48) JADUs in conjunction with the
Project, which shall be deed-restricted for lower income households, and which shall satisfy the
Project's affordable housing obligation under the City's local Inclusionary Zoning Ordinance.
vii. Designation of the City as the Point of Sale for Project-related construction
materials and fixtures, to the extent permitted under applicable law.
10. CEQA Compliance. An Addendum to the Project EIR was prepared for and adopted
by City. The Addendum was prepared to determine whether or not the Project EIR prepared for
and certified by the County of Alameda for the County Proposal remains sufficient to address
the potential impacts of the Project being proposed in City, which was a responsible agency for
purposes of the Project EIR, or whether additional documentation is required under the
California Environmental Quality Act(Public Resources Code [PRC] § 21000, et seq. and Cal.
Code of Regulations, Tit. 14, Div. 6, Chapter 3, §§ 15000-15387) (CEQA). Pursuant to CEQA
Guidelines Sections 15162 and 15164, the Addendum evaluated the proposed changes and
documented the basis for the conclusion that the proposed changes would not result in new
significant environmental impacts or a substantial increase in the severity of previously identified
impacts, and further, that no new information of substantial importance has occurred. Therefore,
it was found and determined by City that preparation of a subsequent or supplemental EIR is
not required.
11. Project Approvals. City has undertaken to consider and approve several actions to
plan for future housing on the Project Site, including, without limitation, the following approvals
(collectively, "Project Approvals"):
a. General Plan Amendment (P25-0116) ("GPA") to designate the Project Site
Medium Density Residential (MDR); PUD Prezoning and Related Development Plan, Vesting
Tentative Map, Pre-Annexation and Development Agreement, Initiation of Annexation
Proceedings. Following review and recommendation by the City Planning Commission and after
a duly noticed public hearing, the City Council approved the proposed GPA via Resolution No.
, introduced ordinances to prezone the Project Site (P25-0118) and approve the related
Planned Unit Development/Planned Unit Development Plan (PUD-154) by Ordinance Nos.
and . The City Council also approved: the Vesting Tentative Map (Tract No. 8423),
this Agreement by introduction of Ordinance No. , and a Resolution to Initiate
Annexation (P25-0115) for the Project as more particularly described in the foregoing City
approval documents. Thereafter, at a duly noticed public hearing, the City Council adopted
Ordinance Nos. , , and , respectively.
b. Approval of Alternative Means of IZO Compliance; Regulatory Affordable
Housing Agreement. The City Council approved Developer's proposed alternative means of
complying with City's Inclusionary Zoning Ordinance ("/ZO") as reflected herein. Related
thereto, the City Council, by Resolution No. , approved a Regulatory Affordable Housing
Agreement (pursuant to City Municipal Code section 17.44.060) for the Project Site, which was
in substantially the same as attached DA Exhibit B (the "Regulatory AHA").
4
