days. Upon any other City breach of this Agreement or its obligations hereunder, Owner, after providing <br />City with written notice of the alleged breach as is reasonably practical in the circumstances, shall have <br />the right to take such legal action against the City and others that may be available at law or in equity as <br />Owner determines to be appropriate. <br />6. Notices. Comments or other notices required or permitted to be given hereunder shall be given in <br />writing and shall be delivered (a) in person, (b) by a nationally recognized overnight delivery service, (c) <br />by certified or registered U.S. Mail with postage prepaid, return receipt requested, or (d) facsimile. <br />Notices shall be effective on the date of delivery or receipt, or if delivery is not accepted, on the earlier of <br />the date that delivery is refused or five (5) days after the date the notice is mailed. Each party shall make <br />an ordinary, good faith effort to ensure that it will accept or receive notices that are given in accordance <br />with this Section 6, and that any person to be given notice actually receives such notice.
