L'- <br /> 3. The five affordable units shall consist of two units utilizing "Plan 6" and three units utilizing <br /> "Plan 7" as described in the approved plans for PUD-99-5. The units shall be located based on the site <br /> plan approved by the City Council. The affordable units shall feature fixtures and finishes as described <br /> in the attached Exhibit A. No additional upgrades or modifications shall be permitted. <br /> 4. The five affordable units shall be built in the first phase of project development. <br /> 5. Developer, in cooperation with City, shall be responsible for marketing and selling the five <br /> affordable units. The sale of the units shall be subject to the standard provisions of the PHAP, including <br /> resale restrictions, and said provisions shall be enforced through deed restrictions recorded against each of <br /> the affordable unit lots. City shall provide Developer with all PHAP-related agreements for recordation <br /> coordinated by Developer. <br /> 6.
