Artist shall hold harmless the City, its Council, officials, employees, <br />volunteers, agents, sponsors, and promoters from any and all claims, demands, liabilities and judgments for, or <br />by reason of, personal injury or death, caused by or arising out of the City's acts or failure to act pursuant to this <br />Agreement. Artist acknowledges that carrying out the Work on the Site involves risks and that serious injuries <br />could occur while Artist is carrying out the Work on the Site, which may include, but is not limited to, working <br />near streets and being hit by a bicyclist or car, tripping on curb and breaking bones, falling off of ladder or stool <br />and sustaining head injury, or inhaling chemical fumes. <br />12. BINDING EFFECT.
