PROMISSORY NOTE <br />$123,412.60 Pleasanton, California <br />September 28 , 1992 <br />FOR VALUE RECEIVED, the undersigned CITY OF PLEASANTON <br />("Maker"), hereby promises to pay to the order of CHANG SU-O LIN, <br />aka JENNIFER LIN, HONG LIEN LIN and HONG YAO LIN ("LIN/HOLDER!"), <br />at CHARTER PROPERTIES, 6601 Owens Drive, Pleasanton, California__ <br />94566, c/o James Tong, or at such other place or to such other- _ <br />party as Holder may from time to time designate in writing, the - <br />principal sum of One Hundred Twenty-three Thousand Four Hundred - <br />Twelve Dollars and Sixty Cents ($123,412.60 ), together with_ <br />interest thereon from July 21, 1992 at the rate described herein. <br />All amounts payable under this Note shall be without offset or-: <br />deduction and shall be payable in lawful money of the United <br />States. Checks will constitute payment only when collected. <br />1. Definitions. <br />In addition to the terms defined elsewhere herein, the <br />following terms shall have the meanings indicated: <br />A. Contract Rate: The rate per annum at which the <br />principal balance of the loan evidenced by this Promissory Note <br />("Note") bears interest at any time during the Term of this Note, <br />calculated on the basis of a 360 day year, as more particularly <br />described in paragraph 2A below. <br />B. Loan Year: Each twelve (12) month period during the <br />Term commencing on July 21, 1992. <br />C.
