ACQUISITION AGREEMENT <br />THIS AGREEMENT is made and entered into on the 21st day of <br />July , 1992, by and between CHANG SU-O LIN aka <br />JENNIFER LIN, HONG LIEN LIN and HONG YAO LIN ("LIN"), and the CITY <br />OF PLEASANTON, a Municipal Corporation ("CITY"). <br />ARTICLE I <br />DEFINITIONS <br />The following terms shall have the meanings set forth in this <br />Article I when used in this Agreement: <br />Section 1.1. Title Company/Escrow Holder. References to <br />Title Company or Escrow Holder shall mean First American Title <br />Guaranty Company, 999 East Stanley Boulevard, Livermore, CA 94550. <br />Section 1.2. Preliminary Report. References to Preliminary <br />Report shall mean that certain Preliminary Report for the property <br />from the Title Company dated June 12, 1992, under Escrow Number <br />590196, copies of which are attached hereto as Exhibit "A" and <br />incorporated herein by reference. <br />Section 1.3. Tank Site. References to Tank Site shall mean <br />that certain Real Property consisting of approximately 6.31 acres <br />located in Alameda County, and identified on Exhibit "B" attached <br />hereto and incorporated herein by reference. <br />Section 1.4. Access Road Easement. References to Access Road <br />Easement shall mean that certain 35-foot wide strip of land between <br />the Tank Site and county road identified as Tassajara Road to be <br />used by the grantee for ingress and egress to and from the Tank <br />Site. The Access Road Easement consists of approximately 1.2 acres <br />and is more specifically identified on Exhibit "C" attached hereto <br />and incorporated herein by reference. <br />Section 1.5. Utility Easement. References to Utility <br />Easement shall mean that certain 35-foot wide strip of land between <br />county road known as Tassajara Road and the Tank Site to be used <br />by the grantee for utility purposes. Said Utility Easement <br />consists of approximately 1.2 acres and is more specifically <br />identified on Exhibit "D" attached hereto and incorporated herein <br />by reference. <br />Section 1.6. Slope Area (License). References to Slope Area <br />shall be to that certain area adjacent to the Access Road Easement <br />to be used in conjunction with the Access Road Easement. Said area <br />consists of approximately .69 acres (Northwesterly) and .83 acres <br />(Southeasterly), and is more specifically identified on Exhibit <br />"E" attached hereto and incorporated herein by reference. <br />1 <br />Lin\docs\acquisit.agr <br />
