Trustee accepts this Trust when this Deed of Trust, duly executed and <br />acknowledged, is made public record as provided by law. Except as otherwise provided by law <br />Trustee is not obligated to notify any party hereto of pending sale under this Deed of Trust or of <br />any action of proceeding in which Trustor, Beneficiary, or Trustee shall be a party unless <br />brought by Trustee. <br /> <br />21. The undersigned Trustor requests that a copy of any notice of default and of any <br />notice of sale hereunder be mailed to Trustor at Trustor's address set forth herein. <br /> <br />22. Notwithstanding anything to the contrary in this Deed of Trust or the Loan <br />Documents, Beneficiary's sole recourse in the event of a default by Trustor shall be to the <br />Property, except in the event of (a) fraud by the Trustor, (b) any material misrepresentation made <br />by the Trustor to Beneficiary in connection with the Loan, or (c) misappropriation by the Trustor <br />of any rents, security deposits, or insurance or condemnation proceeds.
