<br />On behalf of my wife, I am writing to express our joint comments & concerns <br />regarding the subject application for conditional use permit. As a homeowner & <br />resident of the Valencia community, we are against the granting of approval due to: <br /> <br />1. Home-based businesses are strictly prohibited by the C C & R terms of our <br />Association. As a condition for purchasing/owning a home in the Community, the <br />applicants agreed to be bound by all terms and conditions of the C C & Rs. No <br />exceptions nor special privileges can be allowed, as doing so will then set a <br />precedent for and/or cause probability of other residents requesting exception to the <br />same or other binding regulations to serve their own individual wants & needs. <br /> <br />2. The lot sizes of the majority of homes, and certainly of the subject address, are <br />not of adequate size to accommodate the recreational needs of so many children on <br />a repeated, daily basis. As such, planned and regular use of the 'small tot' <br />playground located in the common area (near to the clubhouse/pool) or linear park <br />will be the most likely end result. <br /> <br />3. The playground areas mentioned in item 2 above were designed & constructed to <br />serve the occasional needs & use of the small residential community in which they <br />are locatedu not a day-care business. <br /> <br />4. The community Association can be held liable for any injury or accident <br />incurred in the common areas of the community. As a member of the Association, I <br />am not willing to accept such significant increase in risk for liability that such a <br />business will generate. <br /> <br />Thank you for your consideration of our concerns.
