Resolution No. 93-139
Page Five

For custom lots, assume Developer A has a custom lot
subdivision of 50 units, and the Council initially
allocated 25 to 1994 and 25 to 1995. If the developer
does not complete the public improvements for the 25 lots
in 1994, the developer must request a further
reallocation. Council reallocates the 25 units to 1996
(rather than 1995 when the developer wanted it). If.an~
-openings occurs in 1995, the suerules as to preference'.
will apply.

14. Custom lots, once the public improvements are completed, will
not be subject to further developer reallocation, but custom
lots will not be sold prior to the time the public
improvements are completed. Custom lot development will be
monitored by staff, and staff will use estimates of actual
custom lot construction in the semi-annual analysis of
projected building star~s. Custom lots projected to star~
construction in a calendar year count toward the General Plan
'. maximum.

15. As an incentive for developers to participate, Council will
consider approving extensions of tentative maps, extensions of
subdivision agreements, and/or PUD modifications. These may
be processed concurrently with the initial reallocation of
units. Such extensions and/or modifications will not be
effective until the City reaches agreement with the developer
concerning the reallocation.

16. Other aspects of the Growth Management Program Ordinance, as
it existed on September 1, 19~3, remain, including:

a. lapsing provisions;
b. fees; and
c. exemptions

~: This resolution shall become effective immediately
upon its passage and adoption.
