CITY OF PLEASANTON <br /> <br /> AGREEMENT FOR SPECIAL SERVICES <br /> <br /> Department of Recreation and Human Resources <br /> <br /> THIS AGREEMENT, is made and entered into in duplicate as of the day of , <br /> <br /> 19 , between the RECREATION DEPARTMENT, of the City of Pleasanton, California, hereafter <br /> <br /> referred to as "City" and ,whose <br /> address is , phone number <br /> hereafter referred to as "Instructor", as follows: <br /> <br /> 1. Instructor agrees to hold class or classes if at least students have enrolled for the <br /> course. City may cancel this agreement by notifying Instructor by <br /> of such cancellation, if fewer than students have enrolled for the course. <br /> <br /> 2. has agreed to conduct a <br /> workshop/class to be held on from to in the <br /> building, located at , Pleasantcn, at $ <br /> per participant. <br /> <br /> 3. The Instructor salary wilI be $ per participant for the workshop/class. The instructor <br /> will receive payment at the conclusion of the workshop/class. <br /> <br /> 4. Instructor understands that City may cancel this agreement at any time should enrollment be <br /> insufficient or should funds or facilities become unavailable or should the Instructor not <br /> perform the services herein to the satisfaction of the City, and the City shall not be liable <br /> for compsensation of Instructor for the remainder of the Agreement should it be cancelled. <br /> <br />5. Instructor shall acquire, repair and maintain at his sole cost and expense such equipment as <br /> Instructor needs for his personal use for the conduct of the aforesaid services. <br /> <br />6. Instructor, in the conduct of the services contemolated hereunder, shall abide by all laws, <br /> ordinances and by all rules and regulations adopted by the Recreation Department of the Cit7 <br /> relating thereto. <br /> <br />7. It is understood and agreed the Instructor in the performance of this contract, is an <br /> independent instructor and not an employee of the Recreation Department or of the City of <br /> Pleasanton or of any organization, group or individuals under Instructor's supervision <br /> or leadership as a result of this contract, and is not sub3ect to the control of the <br /> Recreation Department except as hereinabove stated. <br /> <br />8. Instructor further agrees to accept all hazards and injuries which Instructor may receive <br /> in the course of performing this contract and agrees to hold harmless the City of Pleasanton, <br /> the City Council, and each member thereof, all officers and employees of the City of <br /> Pleasanton and any organization, group, or individual herein under the supervision of the <br /> Instructor, as a result of this contract, for any injury to Instructor, or property of the <br /> Instructor which Instructor receives in the performance of his duties under the terms of this <br /> contract or for any act of which Instructor may be adjusted liable.
