Ruby Hill Event Center
PUD-93-02-08M

c) Involve other changes in the existing environment 0
which, due to their location or nature, could result
in conversion of Fannland, to non-agricultural
use?

o

[KJ

o

Discussion

a) The Deed of Perpetual Agricultural Conservation Easement, recorded on the subject land
in September 1998 allows for an approximately 3.8-acre portion ofthe 54.97-acre site to
be used for agriculture and residential uses associated with the agricultural use of the
property. Permitted use includes winery, tasting rooms, residence, and structures
necessary for any other commercial uses. The proposed development includes the
construction of an event center/winery building and parking area within the 3.8-acre
easement area. The proposed development would remove some of the existing vineyards
that are 10cated within the easement area. However, the overall required acreage area for
agricultural use would be retained. Therefore, this would be a less-than-significant-
impact.

b) Agriculture Resource impacts from the proposed development in minimal. The acreage
specified for agricultural use on the subject site is to be retained in a manner conforming
to the Deed of Perpetual Agricultural Conservation Easement. Therefore, this would be a
less-than-significant-impact.

c) The portion of the land that would be used for an event center/winery, wine tasting room,
barrel storages, and residence would be within the acreage specified in the Deed of
Perpetual Agricultural Conservation Easement. The proposed land use change is less
than significant in that the majority of the land would continue to be used as agriculture
purpose. Therefore, this would be a less-than-significant-impact.

3. AIR QUALITY

Environmental Setting

The Bay Area has remained one of the cleanest of the five major urban Califomia air basins in
recent years. However, there are still several days annually when air pollution exceeds the
federal and state air quality standards. These standards, set at different concentrations for each
ofthe major air pollutants have been developed to protect public health.

The Bay Area Air Quality Management District (BAAQMD) regulates air quality in the Bay
Area Region through its permit authority over most stationary emission sources and through its
planning and review activities. The BAAQMD is the main permitting agency for air pollutant
2
sources.

9
