5. Whether adequate public safety measures have been incorporated into the design of
the proposed development plan modification:

.

All uses and their tcnancies would be designed and operated to meet the requirements
of the Uniform Building Code and City Fire Codes, other applicable City codes, and
State of California rnandatcd noise, energy, and accessibility requirements.

.

The project site adjoins existing public strects with adequate crnergency vehicle ac-
cess and proposed parking areas to scrve these uses. All strcets, accesscs, and drivc-
way aisles meet City standards and arc adequate to handle anticipated traffic volumes.

Adequate access is providcd to all structures for police, fire, and other ernergency vc-
hiclcs.

.

Staff, thercfore, bclieves that this finding can be madc.

6. Whether the proposed development plan modification conforms to the purposes of
the PUD District:

The proposcd PUD developmcnt plan modification implements the purposcs of the
City's PUD Ordinancc by augmenting the existing servicc commcrcial uses allowed
on the site with ncighborhood commercial uses that would serve the busincss park
tenants as well as thc nearby rcsidential areas. Thc proposed uscs conforrn to the
property's underlying land use designation of the Pleasanton General Plan.

Staff, therefore, believcs that this finding can be made.

X. CONCLUSION

The proposcd project is a commercial center on an infill propcrty in an existing business park
surround cd by busincss park uscs. The subject propcrty is zoned PUD-C (Planned Unit Dcvel-
opment - Commcrcial) District. This devclopmcnt is consistent with the Plcasanton General
Plan land usc designations. The project will not include any activities or uses causing substan-
tial adverse effects on human beings either dircctly or indirectly or on the environment. The
project has bcen designed to meet the gcneral development standards required by the City of
Pleasanton and will incorporatc conditions of approval to meet local codes and regulations.

This dcvelopment will serve the residential ncighborhoods to the south, southwest, and south-
cast. The proposed uses facilitate the traffic principlc of pass by and internal trip capture to re-
duce its net impact to thc City's strcet system. It would dircctly mitigate thc Stanley Boule-
vard/Valley A venue/Bernal A venue intersection for the existing/approved/project scenario and
will contribute traHic fces for use to impacted intersections throughout the City.

Staff understands the community concern and opposition to the proposal based on traflic and
staff has been especially sensitive to this concern/opposition in securing mitigation and design
features - for example, separated sidewalks for bicyclists and pedestrians, a radar detccted speed

I'CUI'-165/I'DR-529/I'MOD-81-25-7 M

I'age 47 of48

December 13, 2006
