20.16.070 20.16.070 Board Of Appeals - Established: There is created and established a Boazd of Appeals consisting of five (5) members. Each member of the Board of Appeals shall be appointed by the Council for a term of two (2) years; provided, that the first two (2) members appointed shall serve a term of one year. The Board shall elect a chairman. The Director of Building Inspection or his representative shall be an ex officio member of said Board and shall serve as secretary. The Board shall adopt reasonable rules and regulations for conducting its business. Any board of appeals appointed by the City Council under the provisions of any other ordi- nance may act as the Board of Appeals provided for in this Chapter when so directed by resolution of the City Coun- cil. (Ord. 1393 § 2, 1989; Prior Code § 2-13.37) 20.16.080 Board Of Appeals - Duties: The Boazd of Appeals shall: A. Upon receipt of a written notice of appeal from the decision of the City Manager by the owner or party in inter- est within thirty (30) days of the date of the service of said decision or order, the Boazd shall entertain such appeal and conduct a hearing thereon as pro- vided in subsection B of this Section. The Board of Appeals shall notify the owner or parties in interest of the heaz- ing date, post the property with a notice of hearing and publish a notice of heaz- ing, all as provided in this Chapter. B. Hold a hearing as required by subsection A of this Section, within twenty one (21) days after receipt of appeal, to heaz such testimony as may be presented by any department of the City or the owner, occupant, mortgagee, lessee or any other person having an interest. C. Make written findings of fact within sixty (60) days of the date of first hearing. D. The Board shall uphold, reverse or modify the City Manager's decision. (Prior Code § 2-14.38) 20.16.090 Notification: A notice given by the Board of Ap- peals shall be served personally or be sent by registered or certified mail, postage prepaid, return receipt request- ed, to the person owning the land on which the building or structure is lo- cated, as such person's name and ad- dress appear on the last equalized as- sessment roll, and to a mortgagee or beneficiazy under any deed of trust of record, at the last known address of such mortgagee or beneficiary; pro- vided, that if the whereabouts of such persons are unknown and the same can- not be ascertained by the Director of Building Inspection in the exercise of reasonable diligence and the Director of Building Inspection shall make an affidavit to that effect, then said notice shall be served by publishing same once each week for two (2) consecutive weeks in a newspaper published in the City and by posting said notice on the property prior to the date of first publi- 710-3 (Pleasanton April 2000)
