led to believe the earlier hours were acceptable. He urged Council to support the terms of the
original agreement, office use only, the gate as it currently exists, 36" box, and small bollards.

Dennis Gade, 2778 Longspur Way, indicated he supported everything Mr. Hunt said.
He supported the parents with children at La Petite. He does have an issue with La Petite. They
knew the gate was to be closed at 6:00 p.m. They have claimed ignorance, but that is no
excuse. If La Petite had been honest with prospective clients, they could have made a decision
as to whether to bring their children there. He indicated he will abide by whatever decision is
made whether to open the gate at 6:00 or 6:30 a.m. However, he is absolutely against keeping
the gate open to 9:00 p.m.
The gate must be closed at 7:30 p.m.

Nancy Pozzebon, 2808 Longspur Way, agreed with the two people before her regarding
the office use, the plantings, and the times of the gate opening/closing.

B. J. Stephens, 2793 Longspur Way, was in sympathy with the parents, but tnkes
exception to the La Petite staff's poor decisions.

Kate Stevens, 2793 Longspur Way, agreed with her neighbors. She was offended by
comments that La Petite had grouchy neighbors that didn't like children. It is not that they don't
llk_~ children, they want what was already promised to them.

Mr. Cave was frustrated because they make headway and give in on points, then they are
told it is not enough. With respect to Building 5, it has always been zoned office/retail. There
was a mistake in the original ordinance, which was corrected. The PUD was never office only
and that has been explained at many meetings. Manulife had a lighting demonstration and spent
time and money to show the homoowners what it would look like. The issue of the maturity of
the landscaping versus the height of the pole has never been an issue in his mind. He feels they
have done a great job in this regard. They have submitted a landscaping plan. He feels a trade
off in lighting v. landscaping is a step back.

Cfhere was discussion about whether the demonstration pole was ten or fifteen feet. )
Ms. Michelotti had a question about the length of time for the gate opening.

Mr. Cave indicated all the discussion at the Planning Commission hearings revolved
around whether the gate should be open at 6:00 or 6:30 a.m. The current ordinance says 6:30
a.m. to 7:30 p.m. The Planning Commission chose 7:00 p.m. for riosing with no discussion
or reasoning. Closing a half hour earlier will impact the businesses.

Ms. Michelotti asked if the lighting was a problem now.

03/19/96 -18-
