(SR96:285)

Michael Roush presented the staff report.

Mr. Tarver felt there were two situations that would cause a vacancy on the Council.
One is from an election and the other is for other reasons that might cause the vacancy to be
close to an upcoming election, such that you would not want to call a special election. Mr.
Tarver indicated his desire for Council discretion if the vacancy occurs less than a year from a
scheduled election. Basically, he wanted a special election to fill a vacancy caused by an
election from a safe seat and Council discretion to appoint if the vacancy were caused by another
reason and occurred less than a year from an election.

Ms. Michelotti asked if the vacancy were caused by a death or resignation, how long
would Mr. Tarver want to operate with a four person Council?

Ms. Acosta thought the issue was one of timing.

09/17/96
-23-
