Item 6b
RZ-9~;-05 - Application to amend the Municipal Code to address brew pubs,
micr0breweries, and Other beemaking establishmentS. (SR95:305)

Brian Swift presented the staff report.

Mayor Tarver opened the public hearing.

Matt Billings, 10 Shore Drive, partner in a brew pub to be located at the former Cheese
Factory, hoped to get Council support for the ordinance so he can open his business.

Ms. Michelotti asked if his business brewed on site and was also a pub.

Mr. Billings stated it was a brewery, brew pub and had food service.

Ms. Michelotti wanted him to be clear that his business was considered a brew pub.

Mayor Tarver commented that business needs a conditional use permit. He did not
understand why Mr. Billings would have to wait for the ordinance to become effective.

Mr. Swift stated the department planned to begin processing the conditional use permit.
The technical issue was whether the conditional use permit could take effect before the ordinance
could take effect. Ordinances take a second reading plus a thirty day review period. Staff
would like the ordinance and the use permit to take effect at the same time.

Mayor Tarvet stated if the Code were not amended, this would be classified as a bar and
would need a conditional use permit.

Mr. Swift indicated a conditional use permit for the bar is allowed under the existing
Code, but the existing Code does not address actual brewing as part of bar use. Brewing is
currently only allowed in industrial zones and that is why the Code needs to be changed.

Mayor Tarver asked when he could open.

Mr. Roush stated if Council introduces the ordinance and the second reading is October
17th, the conditional use permit could be processed. If it were approved by the Planning
Commission, it could become effective the date the ordinance became effective, in approximately
six weeks from tonight.

Dennis Gade, 2778 Longspur Way, questioned the planned microbrewery that will go in
to the Hopyard Plaza Center. He felt smells during the brewing process might become
offensive, but the ordinance, as it is drafted, does have a means to have that problem corrected
if it became a problem. Mr. Gade questioned the approval process. Are shortcuts being taken
in the approval process to allow these business owners to get into operation in a manner that

10/03/95 -9-
