356

6. PUBLIC HEARINGS
Item 6a
AP-91-3/V-91-9. Michael Peel and Darlene Crane, Appeal of the
Planninu Commission Denial of V-91-9, an Application for a Variance
from the Municipal Code to Allow the Construction of a New Home
that Would Encroach Within the Required Front and Side Yard
Setbacks of the Property Located at 952 Gray Fox CirCle
(Tract 5188, Lot 12) (SR 91:319)

Mr. Mercer declared the public hearing open on the
application.

Mr. Michael Peel, 530 Dolores Place, with Darlene Crane,
4275 Miramount Drive, and Doug Johnson, builder of the project,
requested that he be granted a slight variation for the development
of his property by reason of the lot's unique situation in terms of
its size, topography and irregular shape. He stated that the
13,600 square-foot lot, which is next to the smallest lot in the
subdivision, has a setback of 35 feet to the north and 32.5 feet to
the south. He added that none of his neighbors have objected to
his request for a variance; in fact, his neighbor to the south has
written a letter stating that the request is reasonable. He
indicated that the house could be moved back to eliminate the
encroachment on the front yard, but it would decrease the size of
the rear yard size considerably. He continued that only the corner
of the unit would encroach within the side yard but that the 30
feet distance between the homes would be maintained. He then
presented plans and showed various sites for the house on the lot.

Mr. Hossein Danesh, 936 Gray Fox Circle, whose property is
right below Mr. Peel's lot, stated that he opposed the plan because
the unit would be only five feet from his property and would be
looking down on his. He inquired if a setback of five feet is
within the City's setback requirements.

Mr. Mercer referred the question to Mr. Swift.

Mr. Swift replied that the Code requires a minimum setback of
five feet, with a total combined setbacks of 30 feet. He stated
that almost all the houses on Gray Fox Circle have the minimum
setback on the downhill side.

Mr. Mercer informed Mr. Danesh that his property would not be
impacted by the variance requested.

- 8 -
8-6-91
