241

Mr. Brandes asked how the back yard and pool situations would
be handled.

Mr. Mercer stated that pool problems could be taken care of
from the viewpoint of safety; however, something should be done
about a person's back yard being so bad that the neighbors can not
use their back yards.

Ms. Mohr commented that value judgment would be necessary
when deciding what reduces property value, since what diminishes
value in one person's eyes may not in another's; one person's junk
may be another's treasure.

It was moved by Mr. Brandes that the ordinance be introduced,
with all reference to adjoining properties and garbage cans
removed and including a provision on trees and overgrown
vegetation over sidewalks.

The motion was not seconded; therefore the motion died.

It was moved by Mr. Mercer, and seconded by Mr. Tarver, that
Ordinance No. 1431 be introduced, to be read by title only and
waiving further reading thereof, amending the Pleasanton Municipal
Code by adding thereto a new Chapter 9.28 to Title 9 (Health and
Safety) concerning property maintenance, deleting therefrom all
references to adjoining properties, devaluation of property and
garbage cans in front yards, and adding thereto a provision on
overgrown vegetation obstructing sidewalks.
The roll call vote was as follows:
AYES: Councilmembers Brandes, Mohr, Tarver and Mayor Mercer
NOES: Councilmember Butler
ABSENT: None
ABSTAIN: None

7. SPECIAL AND INFORMATION REPORTS
Item 7a
Minutes of Staff Traffic Committee Meeting of 8-3-89

Mr. Elliott presented his report (IR 89:60) regarding the
matter.

Mr. Brandes inquired if the item on the reduction of the
southbound lanes from three to two and back to three again on
Santa Rita Road would be considered by the Traffic Committee

Mr. van Gelder replied that notices would be sent to the
property owners in the area informing them of the date the signs
would be put up so they could let the City know if the changes
would pose any major problems. He added that this would be ready
for the next Council meeting.

Mr. Mercer informed the assembly that Item 12a would be
discussed before proceeding with the other items on SPECIAL AND
INFORMATION REPORTS.

-17-

8-15-89
