177

Councilmember Mohr asked if they are looking at recreation locations both
within and without Hacienda. Mr. Callahan stated they have looked at two of
the high school facilities but ran into a strange legal problem that has made
that a difficult situation and not feasible; that is why he has gone back to
the Center, where there is less impact and better accessibility for Hacienda
employees as well as surrounding business parks.

There being no further testimony, Mayor Brandes declared the public hear-
ing closed.

Councilmember Butler stated that with regard to the Environmental Impact
Report, he felt the findings are appropriate; they point out where the sig-
nificant impacts are, such as traffic, noise, etc. As pointed out earlier,
the City is not in the same financial position it was several years ago;
largely because of that economic benefit to the City 9overnment, it is not a
major consideration at this point. Likewise some of the other overriding con-
siderations could be treated as frosting on the cake; they are important but
they are not the real major benefit. The most important is employment and the
impact that has on the City's residents well being. The economy of the area
as a whole benefits tremendously from this kind of development. That has a
ripple effect on businesses throughout the City and in the area. It also has
impact on housing. Generally people will be better off for this development.
That employment also leads to important contributions to the cultural and so-
cial life of the City.

It was moved by Councilmember Butler, and seonded by Councilmember Wood,
that Resolution No. 86-84, certifying that the City Council has reviewed and
considered the information in the Environmental Impact Report and has deter-
mined it to be completed in compliance with CEQA, be adopted.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes
NOES: None
ABSENT: None

It was moved by Councilmember Mercer, and seconded by Councilmember But-
ler, that Resolution No. 86-85, making the findings contained in the "Proposed
Environmental Impact Findings" including overriding considerations and approve
the General Plan Growth Management Element revision to clarify that the
"balance among land uses" includes Hacienda Business Park-II in addition to
all other approved employement generating uses; and approve GP-85-4, applica-
tion of Prudential Insurance Company for land use designation change to "In-
dustrial, Commercial, and Offices" relative to a proposed business park
development to be located on an approximately 260 acre site located generally
in the area bounded by Interstate 580 on the north, Tassajara Creek on the
east, and railroad tracks of the Southern Pacific Trnsportation Company and
Hacienda Business Park on the south, and Chabot Drive on the west, be adopted.
The roll call vote was as follows:
AYES: Councilmembers Butler, Mercer, Mohr, Wood, and Mayor Brandes
NOES: None
ABSENT: None

After discussion, it was moved by Councilmember Mohr, and seconded by
Councilmember Mercer, that Ordinance No. 1246, to be read by title only and
waiving further reading thereof, making the findings contained in the "Pro-
posed Environmental Impact Findings", including overriding considerations and
initiate ordinance to approve the rezoning of the project site to "PUD-

- 13- 3-4-86
