It was moved by Ms. Ayala, seconded by Ms. Hosterman, to approve Option 3 with
a revision to future preannexation agreements to indieate the owners vote would be in
favor of annexation.

The roll call vote was as follows:
AYES: Ayala, Brozosky, Campbell, Hosterman, and Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

Mr. Campbell believed that Council should not set policies to make people happy, it
should set policies that are fair. He agreed Option 3 was the most fair. He was uncomfortable
with the proposed answer to the agreement because he did not want to influence how a person
votes.

Mayor Pieo disagreed. If the City is providing water and sewer services, it is done with
the express understanding that when an opportunity for annexation arose, that the property owner
would agree to annex to the City.

There was a break at 9:06 p.m.

The meeting reconvened at 9:15 p.m.

Item 6b
PAP-41 (PCUP-47/PDR-183/PV-64, Waterhouse Management Company)
Appflcation for (1) conditional use permit and design review approvals to allow the
addition of three mobile home spaces and relocation of the existing RV storage area and
carwash shed; and (2) variance from the Municipal Code to reduce the rear yard setback
for the proposed three mobile homes from the required 30 ft. to 3 ft.

The appeals have been withdrawn.

Item 6c
Status of Amended Cooperative Fee (School Impact Fee) Agreement (SR 02:287)

Mr. Bmzosky announced that his property was within 500 feet of the Neal Elementary
School site and therefore it could be perceived that he had a conflict of interest. He therefore
would abstain from this discussion. He stepped down from the dais.

Michael Roush presented the staff report.

Ms. Ayala said when the original Cooperative Fee Agreement was amended, the word
"timely" was brought up in the hearings. She felt that was important because of the lack of
infrastructure at the time.

Pleasanton City Council 12 12/03/02
Minutes
