Phil Rowe, Delco Builders, asked if the term developers applied to Signature Properties
and Ponderosa Homes?

Mr. Roush said the signatories to the Cooperative Fee Agreement are Signature
Properties and Standard Pacific.

Mr. Rowe said he had signed the Gift Agreement with the expectation that Neal School
would be built by now or by the time they expected to be building in the Vineyard Corridor. The
fee is significant, but made sense to them. Having a school built at the same time as the homes
would help property values and home sales. His concern now is the school may be delayed until
2005. The date has been moved so many times, there is not much credibility left. The City is
proceeding with the infrastructure and he is moving forward with home construction. He would
like to have a date ceFtain for school construction. He would help as much as possible.

Mr. Campbell asked how the economy affected his decision to build or not.

Mr. Rowe said it had everything to do with it. Everyone's expectation at this point is that
next year the economy will be better and they will get started with construction next spring and
summer.

Ms. Ayala clarified that all those developers who signed the Gift Agreement have been
paying the fees toward the building of school facilities. Even though the school isn't built, those
developers have been paying the required fee.

Mr. Rowe said the best example is Cn'eenbriar, which had an agreement in place for the
Bernal Property and agreed to match the other developers' fee of $6.50 per square foot.

Laura Danielson, 2349 Romano Circle, said a commitment was made to the children of
the community on many occasions. People who built custom homes have also paid fees and are
committed to building the school. Developers have an interest in selling their homes and we
have an interest in having our children together in a school. She thanked the City for whatever it
can do to help move this process forward.

Ms. Ayala said she is increasingly uncomfortable with the negative articles that are
appearing in letters to the editor about the eastern part of town. She apologized to the residents
in the area and indicated every child should receive the same type of facilities.

Ms. Danielson appreciated that. She said the residents coach soccer, volunteer at schools,
work on City commissions just like everyone else in the community. It is unfortunate other
people see them as different and wanting something they don't deserve.

Tim Kleffman, 5073 Lynbrook Court, said the staff report contains some good
recommendations, but he would like to see them expanded. He wanted staff to identify any and
all potential actions, including litigation, to solve what he considers to be three major problems
with Neal School. The first is the continued delay in the construction of Neal School. He felt
the School Board motion would allow even further delays. He wanted Council to see if it could

Pleasanton City Council 14 12/03/02
Minutes
