Ms. Ayala asked staff to clarify the intent and language of the agreement regarding the
$8.5 million and any costs over that.

Mayor Pico said there is a dispute on the interpretation of that and that is one of the issues
we are trying to resolve.

Mr. Roush said his understanding was there was a cap of $8.5 million for reimbursement
to the Cooperative Fee Agreement developers, unless the changes were requested by the School
District. However, it is possible that people interpret agreements differently and it is hopeful that
those differences can be resolved so that the school is built in a timely way.

Ms. Ayala felt it was important for the public to understand that when Council accepted
this agreement, what its intent was in signing it. The public has been given so much information,
she felt it was important to be aware certain explicit promises were made in the agreement and
who has or has not lived up to the promises. Part of her concern is how to move this along and
what actions the City can take to allow for that.

Mayor Pico said staff has made recommendations on what actions can be taken to move
it along.

Colleen Schwartz, 2345 E. Ruby Hill Drive, said she likes to give people the benefit of
the doubt. After going to School Board meetings the last couple of years, she now has complete
doubt. The District keeps setting target dates, and now there is a target date of 2004. She wants
that to be accurate since she has children who are growing up while these meetings take place.
Until she sees a flow chart or ground breaking date, the target date does not mean much. She
understands there are complications to this issue. She agreed the school project should go to bid
soon and acknowledged that it might cost more than when this all first started. She wanted a
flow chart prepared and strongly urged the school to be built by 2004.

Mayor Pico said the first step on that flow chart is for the District to tell the Cooperative
Fee developers when the infrastructure to the site is available. That starts the construction
period. That is the area for which the City has an opportunity to have significant input. The City
has worked with the District to find a way to finance the infrastructure. A flow chart cannot be
prepared until it is known when it is feasible for the site to be ready for construction.

Ms. Ayala asked when a timeline could be developed.

Mr. Grubstick said the infrastructure could be completed by September 2003. Staff
anticipated the utilities would be in place in the graded roadway in April 2003. Site work could
start before September, perhaps July or August.

Bruce Torguemada, 3072 Albumi Court, felt it was important for staff to stay on top of
the Neal School situation. Eastern Pleasanton is part of the City and he was disturbed by some
of the letters to the editor. It is unfortunate people who are not fully informed of the issues are
making comments that are not tree. He referred to the term "analysis paralysis" and he believed
we are seeing the downside of that effect. There are questions about operating costs, building

Pleasanton City Council 16 12/03/02
Minutes
