limits. Mr. Singleton's property has recently had a fire and he is now looking at what his
options are, in terms of rebuilding his house. To date, he has not been interested in
adding sidewalks to the back of his property. He had not talked with Mr. Gonsalves
recently. In the past, neither of the property owners indicated that they were in any hurry
to develop their properties. They were interested in development when the Walnut Glen
Estates subdivision was approved. They worked very closely with that developer to
design the street pattern so that only 8' of right of way would come offoftheir properties.
There are sewer and water stubs built into the street to serve their property.

Mayor Pico asked, if the City wanted to complete the sidewalk on the Peterson
side to cormeet all the way along Dennis to Newton, then the City would have condenm
that part of two parcels of land and probably have to pay for the replacement of a barn or
the value of a structure?

Mr. Swirl agreed, assuming that an agreement could not be reached for either
dedication or purchase. The City tries first to negotiate something.

Mayor Pico asked if it were within the purview of the Council to impose as a
condition that the sidewalk be extended completely down Dentils to connect to Newton,
with either the City of the Petersons, or a combination, being responsible for the cost.

Mr. Swirl said that could be a condition of the project. It should be clear if it were
a condition for the Petersons, then they would be entitled to reimbursement. Council
might find that the City would have to participate in order to acquire the property through
condenmation, even if the Petersons ultimateiy are funding it.

Mayor Pico said the City could potentially bear the burden of the cost of the
condemnation. The City cannot condemn property for private use it must be for a public
sidewalk. The City could require the Petersons to pay for that. The City could require
the Petersons to advance the funds for the actual construction of the sidewalk, subject to
reimbursement at a later point.

Mr. Swift said this is no different from any other off-site improvement, other than
the fact that Council may have to do condemnation to acquire it. Off-site improvements
like this are subject to reimbursement agreements. A key would be whether the City
would require an interim sidewalk, or require the permanent sidewalk to be built, which
is approximately 13' in back of the existing curb.

Ms. Hosterman said that in a situation where the City was able to achieve a
dedication of the property running along Dennis, in front of the Singleton property and
the Gonsalves property, if the Petersons were to advance the funds to make sure that the
entire strip was sidewalk, how much would that cost? Is there any way of knowing how
much that would cost to install that sidewalk the entire length of the roadway?

Mr. Swift did not have an immediate estimate. The right of way is going to cost
more than the sidewalk.

Pleasanton City Council 12 09.02.03
Minutes
