(3) The Trustee shall deposit in the Certificate <br /> Reserve Fund to be established pursuant to Section 4(c) <br /> of the Facility Lease a sum equal to the Certificate <br /> Reserve Fund Requirement, as such term is defined in the <br /> Facility Lease. <br /> <br /> (4) The Trustee shall deposit in the Insurance <br /> Reserve Fund to be established pursuant to Section 4(d) <br /> of the Facility Lease a sum equal to the insurance <br /> Reserve Fund Requirement, as such term is defined in the <br /> Facility Lease. <br /> <br /> (5) The Trustee shall set aside the remainder of <br /> said proceeds in a separate fund to be known as the <br /> "Acquisition and Construction Fund," which the Trustee <br /> hereby agrees to establish and maintain. The money in <br /> the Acquisition and Construction Fund shall be used and <br /> disbursed in the manner provided in Section 3.03. <br /> <br /> SECTION 3.03. Use of Moneys in the Acquisition and <br />Construction Fund. All moneys in the Acquisition and <br />Construction Fund shall be held by the Trustee in trust and <br />applied by the Trustee to the payment of Capital Project I <br />Costs and Capital Project II Costs and of expenses incident <br />thereto (or for making reimbursements to the Corporation or <br />the City or any other person, firm or corporation for such <br />costs theretofore or thereafter paid by him or it), including <br />insurance premiums, the fees and expenses of the Trustee, <br />expenses in connection with the preparation, issuance and <br />delivery of the Certificates, legal fees and expenses of <br />counsel, and similar expenses. The City, to the extent it has <br />any interest in the Acquisition and Construction Fund, and the <br />Corporation hereby pledge and grant a lien on and a security <br />interest in the Acquisition and Construction Fund to the <br />Trustee in order to secure the City's obligation to pay the <br />Base Rental Payments in the event of a default under the <br />Facility Lease. <br /> <br /> Before any payment is made from the Acquisition and <br />Construction Fund by the Trustee (except for the payment of <br />rental to the City under the Site Lease), the Corporation <br />shall cause to be filed with the Trustee: <br /> <br /> (1) a Written Request of the Corporation, with the <br /> approval of the City Engineer of the City or his <br /> duly authorized representative endorsed thereon, <br /> showing with respect to each payment to be made: <br /> <br /> (i) the item number of the payment; <br /> <br /> 24 <br />1451S <br /> <br /> <br />
