AGENCY AGREEMENT <br /> <br /> This AGENCY AGREEMENT, made and entered into as of <br />October 1, 1987, by and between the CITY OF PLEASANTON PUBLIC <br />FACILITIES CORPORATION, a nonprofit corporation duly organized <br />and existing under and bv virtue of the laws of the State of <br />California (the "Corporation"), and the CITY OF PLEASANTON, a <br />municipal corporation of the State of California (the "City"); <br /> <br /> W I TNE S SETH: <br /> <br /> WHEREAS, the City and the Corporation have entered <br />into a facility lease entitled "Facility Lease (Capital <br />Projects I and I I )" and dated as of October 1, 1987 ( the <br />"Facility Lease") whereby the Corporation has agreed to cause <br />to be constructed a new water reservoir and pipeline ("Capital <br />Project I" ) to be located approximately 1,300 feet northeast <br />of the intersection of Alisal Road and Sycamore Road in the <br />County of Alameda and to acquire an office building ("Capital <br />Project II") to be located at 123 Main Street in the City of <br />Pleasanton (together, herein called "Capital Projects I and <br />II") and to lease Capital Projects I and II to the City, as <br />provided therein; and <br /> <br /> WHEREAS, under and pursuant to the Facility Lease, <br />the City is obligated to make rental payments to the <br />Corporation for the lease of Capital Projects I and II; and <br /> <br />1455S <br /> <br /> <br />
