Section 1. City to Act as Agent for the Corporation. <br />The Corporation hereby appoints the City to act as <br />the agent of the Corporation in connection with the design and <br />construction of Capital Project I. The City, as the agent of <br />the Corporation for the foregoing purpose, shall cause the <br />design and construction of Capital Project I to be completed <br />in accordance with the plans and specifications, bidding <br />documents and construction contract for Capital Project I <br />heretofore approved by the City and with the Facility Lease <br />and Trust Agreement and any applicable requirements of <br />governmental authorities and law. The Corporation shall not <br />be accountable for the acts of the City as its agent hereunder <br />and the City hereby assumes total responsibility for the <br />performance of its duties hereunder. <br /> <br /> The City shall comply with all statutes and laws <br />applicable to the construction of Capital Project I, including <br />all public bidding laws applicable to the construction of <br />Capital Project I by the City and all laws regarding the <br />design, approval and construction of public projects by cities <br />in the State of California. <br /> <br /> Section 2. Acceptance. <br /> <br /> The City, for one dollar ($1.00) and other good and <br />valuable consideration in hand received, does hereby accept <br />the foregoing appointment as agent of the Corporation for the <br />purposes set forth in Section 1 hereof, and designates the <br /> <br /> 3 <br />1455S <br /> <br /> <br />
