results which the City intends therefor, or (3) is safe in any <br />manner or respect. <br /> <br /> The Corporation makes no express or implied warranty <br />or representation of any kind whatsoever with respect to <br />Capital Project I or any component part thereof in connection <br />with the lease of Capital PrOject I to the City, the transfer <br />of title thereof to the City or any other circumstance <br />whatsoever with respect thereto, including but not limited to <br />any warranty or representation with respect to: the <br />merchantability or the fitness or suitability thereof for any <br />purpose~ the design or condition thereof; the safety, <br />workmanship, quality or capacity thereof; compliance thereof <br />with the requirements of any law, rule, specification or <br />contract pertaining thereto; any latent defect; the title to <br />or interest of the Corporation thereof beyond that title or <br />interest which the City obtains for the Corporation pursuant <br />hereto; the ability thereof to perform any function; that the <br />proceeds derived from the sale of the Certificates will be <br />sufficient (together with other available funds of the City) <br />to pay the cost of designing and constructing Capital <br />Project I; or any other characteristic of Capital Project I; <br />it being agreed that all risks relating to Capital Project I <br />or the transactions contemplated hereby or by the Facility <br />Lease, the Assignment Agreement or the Trust Agreement 'are to <br />be borne by the City, and the benefits of any and all implied <br /> <br /> 5 <br />1455S <br /> <br /> <br />
